About This Policy
This Policy outlines the applicable Indian law, jurisdiction, dispute-resolution principles and treatment of third-party product agreements for SafalSevaKendra.
Purpose and Scope
This Governing Law & Jurisdiction Policy explains the legal framework applicable to use of www.safalsevakendra.in and services made available by Prosper Professional Development Life Private Limited (“Prosper”), including gift cards, vouchers, and related services, subject to the applicable product terms.
Governing Law
This Policy and, to the extent applicable, disputes arising from use of the website or services provided by Prosper shall be governed by the laws of India, without prejudice to mandatory consumer protection, payment-system, data protection, and other statutory rights or remedies available under applicable law.
Jurisdiction
Subject to applicable law and the jurisdiction of statutory authorities, courts or forums having mandatory jurisdiction, disputes relating to this Policy or the website shall be brought before the competent courts in the jurisdiction where Prosper’s registered office is situated, if legally permissible. The company’s registered-office jurisdiction should be confirmed and inserted by legal counsel before publication.
Nothing in this clause restricts a consumer from approaching a consumer commission, regulator, or other forum where the law permits or requires the consumer to do so.
Required before publication
Confirm the company’s registered-office address and applicable court jurisdiction with Indian legal counsel. Do not insert an assumed city or court.
Third-Party Products and Agreements
Gift cards, vouchers, prepaid instruments, payment services, and merchant products may be issued, operated, or fulfilled by third-party banks, authorised PPI issuers, merchants, or service providers. Such products may be subject to separate terms, governing-law provisions, dispute procedures, and regulatory requirements. Where applicable, the relevant provider’s product terms and agreements will also apply. This Policy does not state or imply that Prosper independently holds an RBI authorisation or an NPCI licence to issue or operate regulated payment products or systems.
Dispute Resolution
Users are encouraged to contact Prosper first to seek resolution of a complaint. This does not prevent a user from approaching a competent court, consumer commission, regulator, or other statutory authority as permitted by applicable law. Any arbitration or other alternative dispute-resolution process will apply only where a valid agreement provides for it and applicable law permits it.
Severability
If any provision of this Policy is held invalid or unenforceable by a competent authority, the remaining provisions will continue to apply to the extent permitted by law.
Updates
Prosper may update this Policy from time to time. The current version should be published on the website with an effective or revision date. Changes will operate subject to applicable law and any required notice.
